The Supreme Special Court takes side on the constitutionality of the measure of detention for public debts
Greece’s Council of State and the Supreme Court of Civil and Penal law (Areios Pagos) both had examined whether the measure of detention for public debts runs afoul the Constitution, reaching adverse decisions (see news item on 23-Jan-08). The Supreme Special Court, Greece’s Supreme “Constitutional Court”, has now resolved the conflict and agreed with the Council of State, by narrow majority (8-5), that the measure is unconstitutional. The Supreme Special Court’s verdict is final and binding.
